CCPA Crackdown: Mandatory Service Charges Declared Illegal & Restaurants Fined

In a landmark enforcement action, the Central Consumer Protection Authority (CCPA) has declared the mandatory levying of service charges by restaurants as an unfair trade practice. Following a surge in consumer complaints, the authority initiated suo motu action against 27 major restaurants across India, imposing fines, ordering refunds, and demanding immediate changes to billing systems to safeguard consumer rights under the Consumer Protection Act, 2019.

Key Highlights of the Regulatory Crackdown

  • Judicial Backing: The CCPA’s action follows a March 28, 2025, judgment by the Delhi High Court, which unequivocally upheld the 2022 CCPA guidelines. The court ruled that mandatory collection is contrary to law and that the CCPA is fully empowered to enforce these rules.

  • Voluntary, Not Mandatory: The CCPA reiterated that service charges must be entirely voluntary and optional. Customers cannot be forced to pay, nor can they be denied entry or service for refusing to pay.

  • GST Violation: The authority noted that service charges were being automatically added to the bill and then subjected to GST, further increasing the financial burden on consumers through unlawful tax computation.

  • Specific Penalties & Cases:

    • China Gate Restaurant Pvt Ltd (Bora Bora), Mumbai: Fined ₹50,000 and ordered to modify its software to remove the default addition of service charges.

    • Cafe Blue Bottle, Patna: Fined ₹30,000 and directed to refund the illegally collected charges to the complainant immediately.

  • Zero-Tolerance Policy: The CCPA is closely monitoring the National Consumer Helpline (NCH) and has warned of “zero tolerance” for restaurants that continue to pre-load bills with service charges without informed consent.

Industry Impact & Consumer Recourse

The ruling clarifies that the price listed on the menu already includes the cost of service. Any additional charge must be at the sole discretion of the consumer. Restaurants are now legally bound to:

  1. Inform guests that the service charge is optional.

  2. Not use default software settings to add the charge automatically.

  3. Refrain from using alternative names (e.g., “Staff Welfare Fund”) to disguise mandatory fees.
